PARTICIPATION AGREEMENT AND RELEASE OF LIABILITY
ATLAS ART PRESS, LLC (Atlas Art Studio)
Held at sing sing sing, market lane, Wexford, PA 15090
In exchange for participating in activities organized by ATLAS ART PRESS LLC, of Wexford, Pennsylvania, 15090, or its employees, representatives or agents (individually and collectively, “ATLAS”) and use of the property, facilities and services of ATLAS, I irrevocably agree for myself and on behalf of any participating minors for whom I am a guardian (interchangeably, “Minor” or “Minors”, and together with me, collectively, “we” or “us” or “our”), to the following terms, conditions and releases of liability (together, this “Agreement”):
1. AGREEMENT TO FOLLOW DIRECTIONS. We agree to observe and obey all posted rules and warnings, and to follow any reasonable oral instructions or directions given by ATLAS.
2. ASSUMPTION OF THE RISKS AND RELEASE. We recognize that there are certain inherent risks associated with participating in activities organized by ATLAS, including the risk of contracting COVID-19 or its variants. We have used art supplies and equipment in the past and are capable of using same and following directions related to same. I assume full responsibility for personal injury to us, and further release and discharge ATLAS for injury, loss or damage arising out of any of our use of or presence upon the facilities of ATLAS, whether caused by the fault of any of us, ATLAS, or other third parties.
3. INDEMNIFICATION. I agree to indemnify and defend ATLAS against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from our participation in activities organized by ATLAS or use of or presence upon the facilities of ATLAS.
4. FEES. I agree to pay for all damages to the facilities or equipment of ATLAS caused by any negligent, reckless, or willful actions by any of us.
5. CONSENT. I, the parent or guardian of my Minors, hereby allow my Minors to participate in actives organized by ATLAS. I agree on behalf of my Minors to all of the terms and conditions of this Agreement. By signing this Agreement, I represent that I have legal authority over and custody of my Minors.
6. MEDICAL AUTHORIZATION. In the event of an injury to my Minors during activities organized by ATLAS, I give my permission to ATLAS to arrange for all reasonably necessary emergency medical treatment, attention, or procedures (‘Treatment”). ATLAS shall have the following powers:
a. The power to seek Treatment on behalf of my Minors, including without limitation, that of a licensed medical physician and/or a hospital;
b. The power to authorize Treatment; and
c. The power to make appropriate decisions regarding clothing, bodily nourishment, and shelter.
I understand and agree that I shall be financially responsible for all Treatment arranged by ATLAS.
7. APPLICABLE LAW. Any legal or equitable claim that may arise between us and ATLAS shall be resolved under Pennsylvania law.
8. HEALTH REGULATIONS COMPLIANCE. I understand that Atlas Art Press, llc goes through great efforts to abide by all government required quarantines and Allegheny County Health mandated guidelines for small businesses. Therefore by enrolling, we will abide by any such rules that are mandated during my child’s and family’s participation in classes and programs.
9. PHOTO PERMISSION. I permit, without limitation or reservation of rights, ATLAS to take and use photographs of us while we participate in activities organized by ATLAS for publicity or promoting ATLAS, unless I expressly have declined to agree to this provision by signing this agreement.
I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
